These General Terms and Conditions of Sale and Use (hereinafter the "GTC") are entered into between SAS LSM Care, a French simplified joint-stock company with a share capital of 1,000 euros, whose registered office is located at 204 boulevard Pereire, 75017 Paris, France, registered with the Paris Trade and Companies Register (RCS) under number 982 034 332, operating the Sorre Paris brand and website (hereinafter "Sorre" or "the Seller"), and any person making a purchase or using the website https://www.sorre-paris.com (hereinafter respectively "the Customer" and "the Site").

Any order placed on the Site implies the prior and unreserved acceptance of these GTC, which the Customer acknowledges having read by ticking the box provided for this purpose before confirming their order.

Article 1. Purpose and scope

These GTC govern access to and use of the Site and the sales of cosmetic products concluded between Sorre and its consumer Customers. They are drawn up in French.

The applicable version is the one in force on the date of the order. Sorre reserves the right to amend the GTC at any time; amendments do not apply to orders already confirmed.

Article 2. Products

The products offered are cosmetic hair and scalp care products, compliant with Regulation (EC) No 1223/2009. Their essential characteristics are described on the product pages, within the meaning of Article L.111-1 of the French Consumer Code.

The photographs and descriptions faithfully reflect the essential qualities of the products. Slight differences in appearance, in particular on-screen colours, may exist without engaging the Seller’s liability, subject to the legal warranties.

Article 3. Prices

Prices are indicated in euros, all taxes included, excluding delivery costs. Delivery costs are indicated to the Customer before the order is confirmed, on a separate line.

Sorre reserves the right to change its prices at any time. The applicable price is the one in force on the day of the order.

For orders delivered to a country whose currency displayed on the Site is not the euro (in particular Switzerland and certain countries of the European Union), prices are displayed and paid in that local currency, at the conversion rate applied on the day of the order; the order is invoiced in that currency.

For deliveries outside the European Union, in particular to Switzerland, prices and delivery costs do not include any customs duties, import taxes or customs clearance fees, which remain the exclusive responsibility of the Customer under the conditions set out in Article 6.

Article 4. Orders

Creating an account is not mandatory: the Customer may order as a guest. The Customer guarantees the accuracy of the information provided.

The order becomes final after confirmation of payment. A confirmation email is sent to the Customer at the address provided. It is advisable to keep it.

Sorre reserves the right to refuse an order for a legitimate reason, in particular in the event of incomplete information, a previous dispute or suspected fraud.

If a product is unavailable after the order has been placed, the Customer is informed and may choose either a refund of the product concerned or its later delivery.

Article 5. Payment

Payment is made online by bank card (Visa, Mastercard, American Express, CB), Apple Pay or Shop Pay, via Shopify Payments, the secure payment solution integrated into Shopify. The Customer’s card is charged when the order is placed. Transactions are secured by the payment provider. Sorre does not store the Customer’s bank details.

Article 6. Delivery

Areas served: mainland France, the European Union and Switzerland.

Indicative delivery times (business days, excluding preparation): - Mainland France: 2 to 5 business days; - European Union: 3 to 7 business days; - Switzerland: 5 to 8 business days, excluding customs clearance.

In mainland France, standard delivery is free for purchases of 95 euros or more. To the European Union, delivery is provided by Colissimo at a rate of 13.90 euros (or its equivalent in the local currency displayed at the time of the order), and free for purchases of 150 euros or more (or the equivalent in the local currency). To Switzerland, delivery is provided by Colissimo at a rate of 13.90 euros (or its equivalent in Swiss francs displayed at the time of the order), and free for purchases of 150 euros or more (or the equivalent in Swiss francs). Express delivery remains at the Customer’s expense. Below the applicable thresholds, and for express delivery, the costs are indicated to the Customer before the order is confirmed, depending on the delivery method and destination.

In accordance with Article L.216-1 of the French Consumer Code, products are delivered within the time indicated at the time of the order. If no time is indicated, delivery takes place within a maximum of thirty days from confirmation of the order. Risk is transferred upon handover of the product to the Customer.

Importation into Switzerland. Deliveries to Switzerland are made on an uncleared basis: the Customer has the status of importer. Swiss import VAT (standard rate of 8.1%), any customs duties and the customs clearance fees charged by the carrier remain the exclusive responsibility of the Customer and are claimed from the Customer upon delivery. These amounts are neither collected nor refunded by Sorre and are not included in the price of the products or in the delivery costs. If the Customer refuses to pay these amounts, resulting in the return or destruction of the parcel, the costs incurred by Sorre may be deducted from the refund.

Article 7. Right of withdrawal

In accordance with Articles L.221-18 et seq. of the French Consumer Code, the Customer has a period of fourteen days from receipt of the product to exercise their right of withdrawal, without having to give any reason.

For reasons of hygiene and health protection, and pursuant to Article L.221-28 3° of the French Consumer Code, cosmetic products unsealed after delivery cannot be returned or refunded. Only products that are unopened, unused and whose sealed packaging is intact may be returned.

To exercise this right, the Customer notifies their decision before the expiry of the period, by email to hello@sorre-paris.com or using the model form appended hereto. The Customer then returns the product without undue delay and at the latest fourteen days after this notification. Return costs are borne by the Customer. The return is made at the Customer’s risk. The right of withdrawal applies under the same conditions to orders delivered to Switzerland. Return costs as well as any customs formalities and fees relating to re-shipment from Switzerland are borne by the Customer.

Sorre refunds the sums paid, including the initial standard delivery costs, no later than fourteen days after being informed of the withdrawal decision. The refund may be deferred until the returned product has been received and checked. The refund is made using the same means of payment as that used for the order, unless the Customer agrees to another means.

Article 8. Legal warranties

Independently of any commercial warranty, the products benefit from the following legal warranties:

- the legal warranty of conformity (Articles L.217-3 et seq. of the French Consumer Code). The Customer has a period of two years from delivery of the product. The Customer may obtain the repair or replacement of the product or, failing that, a price reduction or the cancellation of the sale, under the conditions provided by law;

- the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code), allowing the Customer to obtain a full or partial refund of a product affected by a defect rendering it unfit for its intended use, within two years of discovery of the defect.

The text of the corresponding articles is reproduced in the appendix hereto. To implement these warranties, the Customer contacts customer service at hello@sorre-paris.com.

Article 9. Liability

Sorre is liable for the proper performance of the contract under the conditions provided by law. Sorre cannot be held liable in the event of non-performance attributable to the Customer, to the unforeseeable and insurmountable act of a third party, or to a case of force majeure within the meaning of Article 1218 of the French Civil Code.

Sorre cannot be held liable for any use of the products that does not comply with their precautions for use.

Nothing in these GTC has the effect of limiting or excluding Sorre’s liability in cases where the law prohibits it, in particular under the legal warranties and in the event of personal injury or fault.

Article 10. Intellectual property

All elements of the Site and the Sorre Paris brand are protected by intellectual property law and remain the property of LSM Care. Any unauthorised reproduction or use is prohibited. Access to the Site does not entail any transfer of rights to the Customer.

Article 11. Personal data

The Customer’s personal data is processed in accordance with the Privacy and Cookies Policy available on the Site.

Article 12. Consumer mediation and cross-border disputes

In accordance with Articles L.612-1 et seq. of the French Consumer Code, the consumer Customer has the right to have recourse, free of charge, to a consumer mediator with a view to the amicable resolution of a dispute, after having first sent a written complaint to Sorre that has remained without a satisfactory response. The request for mediation may be submitted within one year of this written complaint.

The contact details of the competent consumer mediator are communicated to the Customer upon request at hello@sorre-paris.com, as well as on the Site as soon as they are made available.

For cross-border disputes relating to an online purchase within the European Union, the Customer may also contact the European Consumer Centre France (https://www.europe-consommateurs.eu). For Customers residing outside the European Union, in particular in Switzerland, this European scheme does not apply; the French consumer mediation referred to above remains available.

Article 13. Governing law and disputes

These GTC are governed by French law.

In the event of a dispute, the Customer shall first send a complaint to Sorre’s customer service. Failing an amicable resolution, the consumer Customer may bring proceedings, at their choice, before one of the courts having territorial jurisdiction under the French Code of Civil Procedure, including the court of the place where they resided at the time the contract was concluded or at the time the harmful event occurred.

Article 15. Pre-contractual information

In accordance with Articles L.111-1 and L.221-5 of the French Consumer Code, the Customer acknowledges having received, before confirming their order, the following information in a legible and comprehensible manner:

- the essential characteristics of the products; - the price of the products and the delivery costs; - the date or timeframe for delivery; - the identity and contact details of the Seller; - information relating to the legal warranties and how to implement them; - the conditions, time limit and procedures for exercising the right of withdrawal, as well as the model form appended hereto; - the possibility of having recourse to a consumer mediator.

Confirmation of the order constitutes acceptance of these GTC and an obligation to pay for the products ordered.

Appendix. Model withdrawal form

Appendix. Provisions relating to the legal warranties

The products sold by Sorre are cosmetic products compliant with Regulation (EC) No 1223/2009. They benefit from the following legal warranties, reproduced below in their version in force.

Legal warranty of conformity (French Consumer Code, Articles L.217-3 et seq.)

The seller is required to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery.

The Customer has a period of two years from delivery of the goods in which to act. Any lack of conformity appearing within twenty-four months of delivery is, unless proven otherwise, presumed to have existed at the time of delivery.

In the event of a lack of conformity, the Customer may request that the goods be brought into conformity by repair or replacement. Failing this, or if bringing the goods into conformity is impossible, requested late or a source of major inconvenience, the Customer may obtain a price reduction or the cancellation of the sale, under the conditions provided by law. The Customer may suspend payment of all or part of the price until the seller has fulfilled its obligations.

The legal warranty of conformity applies independently of any commercial warranty.

Warranty against hidden defects (French Civil Code, Articles 1641 et seq.)

The seller is bound by a warranty against hidden defects in the item sold that render it unfit for its intended use, or that so diminish that use that the Customer would not have purchased it, or would only have paid a lower price for it, had they known of them (Article 1641 of the French Civil Code).

An action resulting from hidden defects may be brought within two years of discovery of the defect. The Customer may choose between the cancellation of the sale and a reduction of the sale price, in accordance with Article 1644 of the French Civil Code.

To assert these warranties, the Customer contacts customer service at hello@sorre-paris.com. Return costs incurred under a legal warranty are refunded upon presentation of proof. Refunds due under the legal warranties are made using the same means of payment as that used for the order.
